Northeast city Rep. Sam Morgan's wife asks DA not to prosecute assault cases against him

 
 

Northeast city Rep. Sam Morgan's wife has asked the El Paso County District Attorney's Office to dismiss the felony and misdemeanor assault charges against him.

Morgan's wife signed affidavits of nonprosecution in late January in the two criminal cases that stem from her allegation that he assaulted her on Oct. 4, 2019.

The El Paso Times is not naming her because she is an alleged victim of domestic abuse.

"I want to advise the Court and the District Attorney that I do not wish to pursue charges against Samuel Warren Morgan," the affidavits filed Jan. 27 state. "I want the prosecution of this case to be withdrawn, dismissed and terminated, and it is my desire that the District Attorney dismiss all such charges against Samuel Warren Morgan."

She could not be reached for comment Tuesday.

Morgan's wife filed for divorce Oct. 10, and a dismissal hearing in that civil case is scheduled for May 8, according to online court records. 

Morgan's wife told police who responded to their home in October that Morgan had been drinking, became upset and struck her with his hand, according to the police report.

Police "observed the complainant (Mrs. Morgan) to be terrified and crying hysterically" and found the District 4 city representative inside an upstairs bedroom with a handgun tucked into his waistband, the report states.

The affidavits of nonprosecution state his wife does not want to testify in either the aggravated assault with a deadly weapon felony case or the assault causing injury to a family misdemeanor case, although she understands she "may be compelled to do so."

Claudia Duran, spokeswoman for the El Paso County District Attorney's Office, said the office does not comment on pending cases.

Morgan said he wanted to consult with his attorney, Leonard Morales, before giving a statement about the new filings in his cases.

Morales later texted the Times, saying Morgan had no comment at this time.

Morgan's misdemeanor case is set for a Wednesday morning status hearing before County Court-at-Law No. 7 Judge Ruben Morales, according to online court records.

A judge's conference hearing is scheduled for April 16 in the final case, with trial scheduled for April 24, according to court records. That case was assigned to 384th state District Judge Patrick Garcia.
